1. Acceptance of Terms
All web pages available at GhostPath.com ("Site") are owned and operated by Ghost Path, Inc. ("Ghost Path"), a corporation formed in the state of Georgia, in the United States. Any access to the site is governed by the Terms of Service ("Terms") described below.
Please read all of the Terms carefully before using the site and our services (as described below). By accessing the site or using our services you are agreeing to be bound by these terms. These terms, together with our Privacy policy, governs our relationship with you in relation to this site. If you disagree with any part of the terms then you may not access the site or the services.

2. Description of Service
Ghost Path is a virtual private network ("VPN") provider. We provide access to our network of VPN servers in exchange for a subscription fee.
Your access to and use of the site may be interrupted from time to time as a result of equipment malfunction, updating, maintenance or repair of the site or any other reason within or outside the control of Ghost Path. Ghost Path reserves the right to suspend or discontinue the availability of the site and/or any service and/or remove any content at any time at its sole discretion and without prior notice. Ghost Path may also impose limits on certain features and services or restrict your access to parts of or all of the site and the services without notice or liability.

3. User Conduct
All content transmitted or received while accessing the service is the sole responsibility of the account holder from which the content originates and you acknowledge and agree that you, and not Ghost Path, are entirely responsible for the content that you post or transmit.
As a condition of use, you agree to not use our services for any unlawful purpose, such as transmitting, accessing, displaying, or distributing unlawful content or data. This includes (but is not limited to) content that:
- -- violates any local, state or federal law
- -- violates the intellectual property rights (such as copyright, trademarks, service marks and patents) of a 3rd party (including Ghost Path)
- -- contains child pornography or violates any child abuse or exploitation laws
- -- contains harassing, threatening, defamatory, slanderous, or libelous content; and is otherwise in violation of any laws or is intended to harm or defraud third parties (including Ghost Path)
- -- contains viruses that cause damage to third parties including Ghost Path
Ghost Path reserves the right to, at its sole discretion, revoke the access to the service of any user in violation of these terms.

4. Collection of Fees
You agree to pay Ghost Path for the services associated with your chosen account type. Payments are due weekly, monthly, or quarterly, on the anniversary of the previous billing. Account will bill automatically to the payment method on file.
Accounts that are past due will have their access to the network of VPN servers temporarily revoked.
Accounts that remain past due for more than 7 days will be closed.

You have to pay for our Service, or we'll close your account.
5. Registration
Services are available only to individuals who are either (i) at least 18 years old, or (ii) at least 14 years old, and who are authorized to access the site and service by a parent or legal guardian. If you have authorized a minor to use the site and service you are responsible for the conduct of such minor while they are using the site and/or service, and the consequences of any misuse by the minor.
If you do not qualify for an account then you may not create an account on the site or use the services.

6. Cancelation and Restoration of Accounts
Either party, you or Ghost Path, has the option to terminate the account's subscription at any time. If you wish to cancel your account you must do so before your next scheduled billing. All cancelations must originate from the website, all other sources will not be considered.
You may reinstate your account after cancelation by contacting the support department or reactivating services via the site.

7. Release and Indemnity
You hereby expressly and irrevocably release and forever discharge Ghost Path, its affiliated and associated companies, and their respective directors, officers, employees, agents, representatives, independent and dependent contractors, licensees, successors and assigns of and from any and all actions, causes of action, suits, proceedings, liability, debts, judgments, claims and demands whatsoever in law or equity which you ever had, now have, or hereafter can, shall or may have, for or by reason of, or arising directly or indirectly out of your use of the site and the services.
You hereby agree to indemnify and hold harmless Ghost Path, its affiliated and associated companies, and their respective directors, officers, employees, agents, representatives, independent and dependent contractors, licensees, successors and assigns from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting from or arising out of (i) a breach of these Terms, (ii) Content posted on the Site, (iii) the use of the Services, by you or any person using your account or Ghost Path Username and password, (iv) any violation of any rights of a third party.

We are not liable for what you do while you use our service.
8. Limitation Of Liability
In no event shall Ghost Path be liable under contract, tort, strict liability, negligence or other Legal theory with respect to the site, the service or any content (i) for any lost profits or Special, indirect, incidental, punitive, or consequential damages of any kind whatsoever, (ii) to provide substitute goods or services, or (iii) for any direct damages.

9. Warranty Disclaimer
The site and the services are provided 'as is' and do not have any warranty. Any warranties, either express or implied, are disclaimed by Ghost Path.

10. Changes To These Terms
Ghost Path reserves the right, at its sole discretion, to modify or replace the terms at any time. If the alterations constitute a material change to the terms, Ghost Path will notify you by posting an announcement on the site. What constitutes a material change will be determined at Ghost Path's sole discretion.
You shall be responsible for reviewing and becoming familiar with any such modifications. Using any service or viewing any content following notification of a material change to the terms shall constitute your acceptance of the Terms as modified.

11. Miscellaneous
The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. Ghost Path shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Ghost Path's reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including "line-noise" interference). If any provision of the Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable. Ghost Path may transfer, assign or delegate the Terms and its rights and obligations without consent.
The Terms shall be governed by and construed in accordance with the laws of the state of Georgia, as if made within Georgia between two residents thereof, and the parties submit to the exclusive jurisdiction of Georgia courts. Both parties agree that the Terms is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of the Terms, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein.
